Marion County Indianapolis READ!!

I found this info from a team forum out of Indy:

If you do not follow local politics and play paintball, you might want to take note of the proposed legislation Proposal 174. Read it its short.

This is a gun related proposal that will limit the shooting of guns and hunting in Marion county. It was started because of a council-woman was upset that someone was firing guns in her neighborhood, something already illegal. We already have laws in place, why do we need new ones?

This law affects YOU if you live in Marion County because it is not limited to real firearms, but includes:

it shall be unlawful for any person to fire off, shoot at another person or otherwise use any dangerous weapon for any purpose other than in defense of his life or the life of another person, or the protection of his property or property entrusted to him by another person, that property being lawful to possess, or for practice at a range under the supervision and operation of a governmental entity, or without the prior written approval of the Sheriff.



Think you can argue that it means real firearms and paintball or airsoft doesn’t apply?

any bullet, pellet, missile or object impelled from any gun, pistol, rifle or weapon operated by means of any explosive charge, or by springs, air pressure or other means

Now it is true that you can apply for a permit to fire if you have a range setup. You have to have the sheriff inspect your location and if they feel it meets the requirements;

(1) does not constitute a danger to persons passing by or residing near the shooting range or to those using the shooting range facility;
(2) is structurally sound or designed so as to prevent stray missiles, bullets, arrows or other object
impelled from a gun, pistol, or any type of weapon from escaping from the boundary or walls of the shooting range; and
(3) has passed a safety inspection.



Oh and you have to pay $100 for inspection, and it is an annual inspection that can be revoked at any time.

Oh and if you fail inspection you become an environmental public nuisance and subject to abatement.

Now there is an exception if you are indoors and firing you may be exempt;

Quote:
use of air, spring, or otherwise activated implements, except anything activated by an explosive charge, does not constitute a shooting range under this ordinance. However, the use of private property for such purpose may violate other Chapters of the Revised Code of the City and County.



So shooting your paintball gun in the back yard may not be legal in Marion County. Maybe it is legal inside your garage – MAYBE

Yes I agree most likely the Sheriff is not caring that you are shooting a paintball gun in your backyard after you fix something or whatnot. However, if your neighbor calls to complain, you could be in trouble.

What can YOU do?
Attend a hearing
In the meantime, be sure to make plans to attend the hearing on Tuesday, April 17, at 5:30 p.m. in Room 260 of the City-County Building, 50 North Alabama Street, Indianapolis.

If you can, go to the hearing, at the least write an intelligent email and send it to the council members letting them know your feelings.

I am not a lawyer and I don’t play one on the internet. I am not in Marion County and will not be affected by this other than I feel it is a violation of second amendment rights. Yes, I am an NRA member.
