this is on topic it started out with the new patent and when SP got onthe fourms on nation for the same thing all they did was go around every question asked of them and bash other companys. this was just to show have bad SP has gotten where they have to bash others then anwser questions asked of them

Sorry--It looks like Thunders avator says "banned" across it to me.

As far as patents go--what we need is some good old common sense--if it's not the same, it's...different!. Another words, if someone takes it to the next level, the old patent doesn't apply, but guess what...a company has to defend themselves in court when sued or they lose (even though they may be right).

I believe these patents last 14 years--time is counting down.

Since the discussion came up here, I just wanted to make sure that folks have the necessary information.

I and several other folks have started to try and put together the PAINTBALL PATENT FOUNDATION. When the issue came up over at M Carter Brown, I offered to help since I have a background in IP for paintball.

I currently have no business affiliations with paintball anymore (working on extracting myself from the industry - almost completely there...) and since I had previously advocated such a thing and think it is worthy of the effort, I decided to get involved.

Here is where we are at: my attorney is in the process of putting together a Wisconsin Corporation, which will then apply for 501(c)3 tax exempt status as an educational organization.

We have secured a website - www.paintballpatent.org - and "pro bono" web work has been offered to put it together. Several of us are gathering information resources (such as IP papers from university law programs, patent blogs, archives, etc).

I have opened up a paypal account to receive donations. Such donations at this time ARE NOT TAX EXEMPT. We've currently been raising an average of about $100 per day so far.

Those funds have and will only be spent at the direction of the group. So far, it has been used to pay the website registration fee.

We have several attorneys on board who have offered some pro-bono support and hope to acquire additional IP attorneys and experienced patent examiners and/or patent agents.

While the genesis of this organization (this time) WAS based upon a particular patent application, the organization itself is not and will not be used as a bully pulpit to attack or play political games with individuals or companies. Believe that or not as your option - but judge actions rather than what you think might be going on.

Some folks have also criticized the effort with the basic argument that it can't possibly accomplish its goals. I'm on the side of that argument with the folks who say "you'll never know until you try".

Ultimately, we hope to establish prior art resources for both the Patent Office and for inventors - references, magazines and prior patent issues that are directly related to paintball technologies and inventions.

This is an activity that has been engaged in by many technology-oriented industries and they have benefitted as an industry due to legal cost savings, having a solider IP foundation (better, stronger patents that can bring in non-industry licensing fees and royalties: can you imagine what it might be like to know that your marker/paint/goggles/gear costs got lowered because the IP holders are making oodles off of airsoft licensing?) and faster development of new technologies.

Going the other route has drained other industries of both their cash and their innovation.

Again, please judge this by actions, not by words. Maybe we won't get anywhere - maybe we'll just end up with a good resource website, or maybe, just maybe, we'll be able to have some positive impact.
